Tools and guidelines for the implementation of the consultation and national legal aspects for the protection of indigenous peoples and communities against violations of their rights.
This module aims to deepen knowledge of the consultation processes carried out in the countries involved in the project and to analyse and reflect on the national and international legal framework of the right to prior, free and informed consultation. That is, to deepen knowledge of the legal guidelines governing consultation in one’s own country, the contradictions between the provisions of the legislation and the reality in the territories and to know the channels and tools necessary to act against violations.
Learning objectives:
- Explain the guidelines for conducting the consultation in one’s own country
- Explain the different instruments designed to regulate the implementation of free, prior and informed consultation
- Demonstrate understanding of the main legal basis of the case(s) study(s) analysed
- Explain the main national mechanisms for the defence of indigenous rights
- List successful experiences on protective measures
- Identify the steps to be taken in the event of a violation of a right
